CowTown Computing Solution's policies and procedures for handling customer information have been created with the understanding that Internet technologies are still evolving and that Internet business methods are continuing to evolve to meet the needs and opportunities of the changing technologies. As a result, CowTown Computing Solution's policies and procedures are subject to change.

In the course of serving its customers, CowTown Computing Solutions acquires, stores and transmits customer communications and information that customers may regard as private or sensitive. CowTown Computing Solutions may contract with other entities to store and transmit data.  Some of this information - such as the customer's name, address, telephone number, and credit card data - is provided to CowTown Computing Solutions by its customers in order to establish service. Other information - such as the customer's account status, name, choice of services, and customer logs - is created and maintained by CowTown Computing Solutions in the normal course of providing service. In addition, CowTown Computing Solutions may store customers' electronic mail and other communications as a necessary incident to the transmission and delivery of those communications.

Data Security

CowTown Computing Solutions, Inc. will protect the confidentiality of its customers' information, account information and personal communications to the fullest extent possible and consistent with the law and the legitimate interests of CowTown Computing Solutions, Inc, its partners, its employees and other customers of CowTown Computing Solution's services. To protect the loss, misuse, and alteration of information that is collected from customers, CowTown Computing Solutions has appropriate physical, electronic, and managerial procedures in place.

Disclosure of customer information and communications

CowTown Computing Solutions, Inc. will not otherwise disclose its customers' personal and account information unless CowTown Computing Solutions has reason to believe that disclosing such information is necessary to identify, make contact with, or bring legal action against someone who may be causing harm or interfering with the rights or property of CowTown Computing Solutions, it's customers, vendors, or others, or where CowTown Computing Solutions, Inc. has a good faith belief that the law requires such disclosure.

Content
All services may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening, obscene, demeaning to others, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold us harmless from any claims resulting from the use of the service which damages the subscriber or any other party.

Note: Sites that promote any illegal activity or content that may be damaging to our servers or any other server on the internet. Links to such materials are also prohibited.

In addition any site selling or promoting Bulk email services is not allowed

Examples of non-acceptable content or links:

  1. Adult Content or Pornography
  2. Pirated software
  3. Hackers programs or archives
  4. Warez Sites

We will be the sole arbiter as to what constitutes a violation of this provision.
Traffic Guidelines
Each account comes with an allotted amount of Data Transfer.  Additional transfer fee's are $8 per gig for each gig over the allotted amount.   Unpaid bandwidth charges may result in account shutdown.
CGI Scripts
Each account comes with its own cgi-bin. You are free to use any CGI scripts you wish, however we reserve the right to disable any CGI script that effects normal server operation.
Server Abuse
Any attempts to undermine or cause harm to a server is strictly prohibited.
Commercial Advertising & Email
Our servers may not be the source, intermediary, or destination address involved in the transmission of spam, flames, or mail bombs. Your domain may not be referenced as originator, intermediary, or reply-to address in any of the above. Advertising sites on other servers which in turn contain links to a domain on our servers is prohibited. We consider spam any mass unsolicited message in the mediums of Newsgroups and Email. If you are found to have spammed or mail bombed, then we will immediately, without warning, disable your domain. In addition, we will impose a $100 penalty for each spam or mail bomb policy violation. We reserve the right to refuse or cancel service to known spammers. Lastly, we reserve the right to determine what violates this policy.

As such, any violation will result in immediate deactivation of services without refund.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold COWTOWN COMPUTING SOLUTIONS, INC. harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against COWTOWN COMPUTING SOLUTIONS, INC, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless COWTOWN COMPUTING SOLUTIONS, INC against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with COWTOWN COMPUTING SOLUTIONS, INC server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party and (3) copyright infringement.
Refusal of Services
We reserve the right to refuse or cancel service at our sole discretion.
